Pursuant to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “EU Regulation”), the company PLATEK S.r.l. (hereinafter also referred to as the “Controller”) wants to describe how its website www.platek.eu (hereinafter referred to as the “Site”) is managed with regard to the processing and protection of the personal data of the users who visit and use it. This general information is provided for the Site only and is not intended for other websites that may be consulted by the user via links on its pages for which the Controller is in no way responsible.

2. Type of data processed

a) Browsing Data: Computer systems and programmes used to operate the Site collect some personal data whose transmission is implicit in the use of Internet communication protocols. This information, even if not collected to be associated with identified interested parties, could - by its nature, through processing and association with data held by third parties - allows users to be identified. This category of data includes the IP addresses or domain names of computers used by users who connect to the Site, the addresses in the Uniform Resource Identifier (URI) notation of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server response (successful, error, etc.), and other parameters relating to the operating system and computer environment.

 

b) Data provided voluntarily by the user: The user is not required to provide any personal data in order to consult the Site. However, the optional, explicit and voluntary sending of personal data to the addresses indicated on this Site, as well as their entry in the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, “Project Information”, and/or “Would you like to receive your copy?” will result in the acquisition of the user’s address and the personal data entered by the latter, which are necessary to follow up on the requests made. The data collected by the Controller are common personal data only. The Controller invite users not to send, in their requests for services or queries, names or other personal data of third parties that are not strictly necessary.

3. Legal basis and purpose of data processing

The legal basis for the processing of Browsing Data (par. 2, lit. a) is to pursue the Controller’s legitimate interests in relation to the management of the Site. Those data will be used by the Controller for the following purposes: enabling access to and navigation on the Site; collection of data and information in an exclusively aggregate and anonymous form in order to verify the proper functioning of the Site; collection of data and information in order to protect the security of the Site (anti-spam filters, firewalls, virus detection) and of users; obtaining anonymous statistical information on the use of the Site. In the event of computer-related crimes against the Site, the browsing data may also be used to ascertain responsibility.

 

For Data provided voluntarily by the user by sending his/her personal data to the addresses indicated in this Site or by filling in the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, “Project Information”, and/or “Would you like to receive your copy?” (par. 2, lit. b), the legal basis for the processing is the legitimate interest of the Controller to give feedback to the user, perform the service or provision requested, including the management of any applications voluntarily sent by the user.

 

 

 

Furthermore, subject to the user’s explicit consent, the data provided by the user through:

  • the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, and/or “Project Information” may be used for sending newsletters by the Controller; 
  • the form “Sign up” may be used for sending the hard copy of the Platek catalogue by the Controller.

 

4. Consequences of failure to provide personal data

The Browsing Data collected in the context of this processing (par. 2, lit. a) are mandatory as they are strictly functional to the computerised management of the Site.

 

The voluntary provision by the user of personal data through the addresses indicated on this Site or by filling in the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, “Project Information”, and/or “Would you like to receive your copy?” (par. 2, lit. b), is mandatory and concerned exclusively with replying to the user’s requests. Therefore, failure to provide such data will make it impossible for the Controller to give a proper answer. 

 

The user’s consent to the processing of personal data provided through the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, and/or “Project Information” for sending newsletters by the Controller is optional: failure to give consent will therefore not prevent the user from filling in the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, and/or “Project Information”, but will not allow the Controller to send its newsletter. Consent to the processing of personal data provided through the “Sign up” form for sending the hard copy of the Platek catalogue by the Controller is also optional: in the absence of consent, the user may still complete the sign-up procedure but the Controller will not be able to send a hard copy of its catalogue. 

 

5. Methods of data processing

The user’s personal data will be processed using manual and/or computerised tools, with organisational procedures related to the purposes of the processing and in such a way as to guarantee the security, integrity and confidentiality of the processed data. The processing may be performed whether or not by electronic means. The processing of your data may be performed through collection, registration, organisation, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, deletion, destruction of data, in electronic and/or paper format, with hardware, software and/or manual equipment, in compliance with the provisions of Article 32 of the GDPR 2016/679. Automated decision-making processes will not be used by the Controller in any way with regard to the personal data collected. The processing is performed by the Controller and/or Authorised Persons and/or external parties, who are appointed as Processors for this purpose. The data will be recorded and stored in both paper and computer files, according to principles of lawfulness, fairness and transparency, with organizational systems related to the purposes of processing. Furthermore, in order to protect the data from (even accidental) destruction or loss, as well as to guarantee their integrity and confidentiality (including against unauthorised access or disclosure) and, in general, to ensure the user’s rights, the Controller implements security measures of a technical and organisational nature, in compliance with the provisions of the EU Regulation (with particular reference to Articles 24, 32, and 35).

 

6. Period for which the personal data will be stored

The Browsing Data (par. 2, lit. a) and Data provided voluntarily by the user through the optional, explicit and voluntary sending of personal data to the addresses indicated on this Site, as well as their entry in the forms “Sign up”, “Book an Appointment”, “Request for Quotation”, “Generic Information”, “Project Information”, and/or “Would you like to receive your copy?” (par. 2, lit. b) will be stored for a period which does not exceed the period necessary for the purposes for which they are collected , without prejudice to the need to keep them for a longer period in accordance with applicable legislation. In cases where processing is based on the user’s explicit consent, the user shall have the right to withdraw this consent at any time. However, this withdrawal shall not affect the lawfulness of processing based on the consent before the withdrawal.

7. Data communication and dissemination

Personal data may be communicated, within the company, to persons authorised to process the data pursuant to Article 29 of EU Regulation (employees and collaborators of the Controller) in accordance with their competence profiles and for the purposes connected with or referable to the processing itself. The collected data may also be communicated to parties outside Platek S.r.l. who are appointed as Processors for this purpose pursuant to Article 28 of the EU Regulation, who work on behalf of the Controller and in accordance with its instructions, but exclusively for activities strictly connected to the purposes indicated above (e.g. to ensure the operation of the Internet service, the management of the IT and telematics system, and the management of addresses and sending of messages via email). A complete and up-to-date list of such persons can be obtained from one of the contacts listed below.

Personal data collected for the indicated purposes will not be disseminated.

 

8. Place of data storage

Personal data are stored at the Controller’s offices and at the locations, within the European Union, where the parties involved in the processing are located.

 

9. Rights of the data subject

Regulation (EU) 2016/679 grants data subjects the exercise of specific rights, including the right to obtain from the Controller:

  • Right of access;
  • Right to rectification;
  • Right to erasure (‘right to be forgotten’);
  • Right to restriction of processing;
  • Right to data portability;
  • Right to object.

In any case, the user has the right to lodge a complaint with the supervisory authority, as provided for in Article 77 of the EU Regulation, or the right to a judicial remedy under Article 79 of the EU Regulation where he or she considers that his or her rights have been infringed as a result of the processing of his or her personal data in non-compliance with the provisions of the EU Regulation.

With regard to data processing carried out on the basis of consent, the user is granted the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
